RIGHTS AND REPRODUCTIONS
Some items in the Historical Resources Department of the Manatee County Clerk of the Circuit Court and Comptroller Office’s online collections are in the public domain and are not subject to copyright protection. The department sites include the Florida Maritime Museum, Historical Records Library, Manatee County Agricultural Museum, Manatee Village Historical Park, and Palmetto Historical Park, hereafter referred to as “the Sites.” The nature of historical, archival and manuscript collections often make it difficult to determine the exact copyright status of an item. Thus, some of the materials provided online are made available under an assertion of fair use (17 U.S.C. 107). In making the determinations of fair use for individual items or collections, the Sites have followed the College Arts Association’s Code of Best Practices in Fair Use for the Visual Arts, https://www.collegeart.org/pdf/fair-use/best-practices-fair-use-visual-arts.pdf
Whenever possible, the Sites provide all known information about copyright owners and other restrictions in the information, or metadata, associated with digital items or collections. The Sites provide this information to assist users in determining the copyright status of an item. Ultimately, however, it is the user's responsibility to use material according to the terms governing its use.
The written permission of any copyright owners, and/or any other rights holders, may be required for distribution, reproduction, or other use of protected items that extends beyond fair use or other statutory exemptions. Responsibility for making an independent legal assessment and independently securing any necessary permissions ultimately rests with persons desiring to use particular items in the context of the intended use.
Unless otherwise stipulated in an individual item’s rights statement, we request that reuse of any item carry the credit line found at the bottom of each object’s description field. The use of any image or text should also be cited accordingly in any website or written work.

About the Clerk’s Office
The Clerk of Circuit Court was established as a public trustee by the Florida Constitution in 1838. The Clerk of the Circuit Court serves as the Clerk of Courts, the Clerk of the Board of County Commissioners, Auditor, Recorder, and Custodian of all County Funds. In Manatee County, the Clerk’s office also administers a local child support enforcement program, violence protection advocacy program, Manatee Teen Court, and the preservation of historical resources through its historical resources department.
